§ 1. General provisions

1. These Terms of Service govern the use of the website available at peekyagency.com (hereinafter: the “Website”).

2. The owner and operator of the Website is:

hereinafter referred to as the “Service Provider”.

3. Every person using the Website (hereinafter: the “User”) is required to read these Terms of Service before using the Website.

4. Using the Website constitutes acceptance of these Terms of Service.

§ 2. Definitions

Terms used in these Terms of Service have the following meanings:

  • Website - the website available at peekyagency.com, including all subpages
  • User - any natural person using the Website
  • Service Provider - PEEKY Jacek Balczewski, owner of the Website
  • Contact form - a form available on the Website enabling the User to send a message to the Service Provider
  • Electronic service - a service provided electronically by the Service Provider to the User via the Website

§ 3. Type and scope of electronic services

1. The Service Provider offers the following electronic services via the Website:

  • providing informational content about the Service Provider's activities, services offered, technologies and portfolio
  • enabling contact with the Service Provider via the contact form
  • providing blog posts and articles

2. Electronic services are provided free of charge, 24 hours a day, 7 days a week.

3. The Service Provider reserves the right to temporary interruptions in access to the Website due to maintenance, updates or technical failures.

4. The Website is informational and presentational in nature. The Service Provider does not sell goods or services through the Website. Any service agreement is concluded outside the Website, based on individual arrangements between the Service Provider and the client.

§ 4. Technical requirements

1. Using the Website requires:

  • a device with internet access
  • a web browser supporting JavaScript and cookies (e.g. Google Chrome, Mozilla Firefox, Microsoft Edge, Safari in current versions)
  • an active internet connection

2. The Service Provider is not responsible for technical issues resulting from the User's lack of technical experience or the inadequacy of their devices or software.

§ 5. Contact form

1. The User may contact the Service Provider using the contact form available at /contact/.

2. Completing the contact form requires providing data necessary for a response, in particular: first name, email address and message content.

3. Submitting the form constitutes entering into an agreement for the provision of an electronic service (handling the inquiry). The agreement is concluded for the time necessary to provide a response.

4. The User may withdraw from the service at any time by contacting the Service Provider at contact@peekyagency.com.

§ 6. Copyright and intellectual property

1. All content published on the Website, in particular: texts, graphics, logos, photographs, icons, video materials, graphic layout, source code and software, are the property of the Service Provider or are used under appropriate licenses and are protected by copyright law.

2. Copying, distributing, modifying or using Website content in whole or in part without the prior written consent of the Service Provider is prohibited, except in cases of fair use as defined by applicable law.

3. Trade names, logos and trademarks presented on the Website (including e-commerce platform logos: Shopify, PrestaShop, WooCommerce, Shopware, WordPress) are the property of their respective owners and are used solely for informational purposes.

§ 7. User obligations

1. The User agrees to use the Website in accordance with applicable law, these Terms of Service and generally accepted principles of fair conduct.

2. The following is prohibited:

  • taking actions that may destabilize or disrupt the operation of the Website
  • attempting to gain unauthorized access to Website resources
  • using the Website to transmit unlawful content, spam or malicious materials
  • automated downloading of Website content (scraping) without the Service Provider's consent

§ 8. Liability

1. The Service Provider has made every effort to ensure that the content on the Website is accurate and up to date, however it does not guarantee its completeness or suitability for any particular purpose.

2. Content presented on the Website, including blog posts and articles, is purely informational and does not constitute an offer within the meaning of applicable civil law, nor legal, tax or technical advice.

3. The Service Provider is not liable for:

  • interruptions in access to the Website caused by technical failures, maintenance or force majeure
  • the content and operation of third-party websites linked from the Website
  • damages resulting from the use of the Website in a manner inconsistent with these Terms
  • consequences of the User providing false or outdated data in the contact form

§ 9. Personal data protection

1. The rules for processing Users' personal data are set out in the Privacy Policy available at: peekyagency.com/privacy-policy/

2. The Privacy Policy constitutes an integral part of these Terms of Service.

§ 10. Complaints procedure

1. The User has the right to file a complaint regarding the functioning of the Website or the electronic services provided.

2. Complaints should be submitted electronically to: contact@peekyagency.com, or in writing to the Service Provider's registered address.

3. A complaint should include: first and last name (or company name), email address, description of the issue and the expected resolution.

4. The Service Provider will process the complaint within 14 days of receipt and inform the User of the outcome via email.

§ 11. Amendments to the Terms

1. The Service Provider reserves the right to amend these Terms of Service.

2. Users will be informed of any significant changes via the Website (e.g. an on-site notice).

3. The current version of the Terms of Service is always available at: peekyagency.com/terms/

4. Continued use of the Website after changes have been made constitutes acceptance of the amended Terms.

§ 12. Final provisions

1. Matters not regulated by these Terms of Service shall be governed by Polish law, in particular: the Civil Code, the Act on Provision of Electronic Services of 18 July 2002, the Personal Data Protection Act, and Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).

2. Any disputes arising from the use of the Website shall be resolved by the court having jurisdiction over the Service Provider's registered office, unless otherwise stipulated by law (in the case of consumers - the court having jurisdiction over the consumer's place of residence).

3. These Terms of Service enter into force on the date of publication on the Website.
